Abstract

The author analyses the concept of impartiality of Judges and Courts, from impartiality idea of common sense and political liberalism. After expounding the principles that can be inferred of the constitutional sentences (and the sentences of the European Court of Human Rights) the author concludes that the criminal inquiry can not be entrusted to a judge. Consequently he proposes that the “Ministerio Público” leads the criminal inquiry, after making a deep change in this institution and in the social culture of impartiality
