DISAPPEARANCE OF THE EXPRESS DISMISSAL AND REDUCTION OF DISMISSAL COSTS

The 2012 Reform has introduced significant and polemic changes aimed at reducing the dismissal cost, especially regarding compensations (module reduction) or procedural salaries (eliminating them in most of the cases). Concurrently, with a minor importance, the relief of company costs has been reduced by decreasing the salaries at the State or the Salary Guarantee Fund’s (the so-called FOGASA) expense.
The resulting regime is hereby reviewed, in the form of essays, with special attention to the aspects of a challenged constitutionality.
