ADMINISTRATIVE LAW, METHOD ADN PRECEDENT

Abstract

Precedent is an essential technique in our legal system. It guarantees equality, consistency and rationality in judicial and administrative decision-making. Its structure and functioning have been studied from diff erent methodological standpoints. Th is paper provides an analysis of these perspectives in the concrete fi eld of administrative law, with the aim of determining its strengths and weaknesses. From the results, we formulate a proposal for understanding the role of precedent in the shaping of law.
