Th e basic problem at the heart of the topic under debate is the possible area of friction between private authority and the public authorities. From this perspective the meaning of private autonomy and its limits are analysed. Its constitutional intersection is found in the dignity of person and the freedom of enterprise and market. With regard limits to private autonomy, the article advocates substituting reference to morality with the term “Best Practice”. As for the public control of said autonomy, this comes within the orbit of the administrative authorities and has as objectives both law enforcement and traffic safety.
