Abstract

This work analyzes the current legal profile of the marriage in Spain. As a case study, the marriage of persons of the same sex has been chosen. This issue has been the core of an emotional debate, in which it has been discussed whether this relationship should and/or could be considered a marriage, or whether the marriage as it has been known up to date has been profoundly and irreversible distorted; namely, the discussion is about the essence of marriage.
On the other hand, the regulation about couples approved by the Regional Governments rules the union of persons of the same or different sex as a legal institution. This leads us to reconsider not only the place of the marriage in our legal system but even its concept
