This essay examines the proposal, currently debated in Spain, to put criminal investigation into the hands of public prosecutors. It holds that there are no constitutional constraints (either for or against) in this field, so that the debate should concentrate on the expediency of the proposedeform. It also examines the conditions that, according to the author, should be met in order to find such refor defensible within a liberal logic. Among them, he thinks it would be particularly important not to give public prosecutors any power different from those usually enjoy by private citizens
