Abstract

 

This article explains the historical regulatory change that the institution of foundations has undergone through in Spain, which was achieved with the Constitution 1998. However, a systematized regulatory regulation was not obtained until the entry into force of Law 30/1994, modified later with the Law 50/2002, both of them on Foundations. In addition, the article also presents the possible performance of economic activities by foundations. This implies a dilemma between their permissiveness and the achievement of their social aims. Finally, due to the exceptional health crisis of Covid-19, an assessment is made about the singular modifications of the current Law on Foundations adapted to the social, economic and health panorama.
