FREEDOM OF EXPRESSION, REGULATION AND PRIVATE MODERATION OF CONTENTS

Abstract

The rights to freedom of expression and freedom of information information are recognized to everyone and can be exercised through any media or technology of his choice. Beyond the original ideas and structure of the Internet, intermediary platforms have become main actors in the process of dissemination and distribution of all types of content. The rights, obligations and responsibilities of these platforms have been subject to regulation, with the models of the European Union and the United States being the most relevant in current legal debates. The decision adopted by a series of platforms to cancel the accounts of US President Donald Trump has spu-rred the debate on whether the application of internal content moderation rules may constitute, under certain circumstances, an act of censorship, and therefore a violation of the fundamental right to freedom of expression.
